MyHomii Pty Ltd ACN 692 314 515 (MyHomii, we, our, us) aims to process personal information in accordance with the Australian Privacy Principles and the Privacy Act 1988 (Cth) (Privacy Act). This Privacy Policy sets out the way in which MyHomii collects, uses, stores and discloses your personal information. This Privacy Policy may be updated from time to time. If practical, we will endeavour to notify you of any updates to our policy (eg through push notifications within our website or the MyHomii application (Platform), or via email).

The Privacy Act defines personal information as information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a material form or not. Personal information includes sensitive information, which is defined under the Privacy Act as information or an opinion about a person's race, ethnic origin, political opinions, membership of political associations and trade associations, religious or philosophical beliefs, sexual orientation or practices, criminal record, health information, genetic information about an individual that is not otherwise health information, biometric information that is used for the purpose of automated biometric verification or biometric identification and biometric templates.

The particular types of personal information that we collect will depend on the nature of our relationship with you, such as whether you have a general enquiry or signed up or been invited to use the Platform.
We collect various types of personal information, including:

(b) email address and telephone number
(c) if you have signed up, or been invited, to use the Platform:
(i) login credentials;
(ii) your insights and preferences in respect of real estate (including, without limitation, your preferred search areas, property types, and property specifications, whether you are looking to buy or sell property, any comments you make in respect of your saved properties);
(iii) if you choose to upload a profile photo of yourself, your image and likeness; (iv) if you choose to upload voice notes, your voice recordings;
(v) any personal information you enter or upload into the Platform, including (without limitation) personal information comprised in any comments, images or documents you store on the Platform; and
(vi) information relating to your use of our services that allow us to improve or personalise your use of our products or services, such as details about your interactions with the Platform and device identifiers (eg IP address).
4. How do we collect personal information?
We collect your personal information from:
(a) you directly, for example when you create an account on the Platform, or submit a query or sign up to our mailing list through our website;
(b) content provided through, or uploaded to, our Platform by you or other users of the Platform;
(c) our suppliers or contractors who are engaged to assist in the provision of our products and services to you; and
(d) from public records or other publicly accessible sources. Unless it is impracticable, we will provide you with the source of your personal information if requested.
5. Anonymity and pseudo-anonymity
Due to the nature of our products and services, it is not practical for us to interact or communicate with you on an anonymous basis or using a pseudonym. In the event MyHomii inadvertently collects personal information from you, or a third party, in circumstances where that information was not requested or solicited (known as unsolicited information), and it is determined by MyHomii (in its absolute discretion) that the personal information is not required, we will endeavour to destroy the information or deidentify that information.

7.1. General
We collect, use and hold your personal information for the following purposes:
(a) to enable you to register to, and use, our website and Platform;
(b) to carry out statistical analysis and improve or personalise our Platform and other services to you;
(c) to provide you with technical support services in respect of the Platform or our website;
(d) to respond to your requests and inquiries;
(e) for marketing (including direct marketing) activities;
(f) to comply with a law, regulation, court order or other legal process;
(g) to investigate or report suspected unlawful activity; and
(h) to protect, enforce or defend our rights. We will not use your sensitive information for direct marketing purposes.

8. Who do we share your personal information with?

(a) other individuals you have invited to view your content on the Platform;
(b) our service providers and partners who assist us to deliver or support our Platform and software services, such as IT or storage service providers or marketing service providers;

(i) by law, regulation, court order or other legal process;

We may disclose personal information to our service providers that are located outside of Australia, including the United Kingdom.
By submitting your personal information to us, you agree and consent to the disclosure, transfer, storing or processing of your personal information outside of Australia.
In providing this consent, you understand and acknowledge that countries outside of Australia do not always have the same privacy protection obligations as Australia in relation to personal information. If you do not agree to the disclosure of your personal information outside Australia, do not submit personal information to us.
10. Automated decision-making
We may use artificial intelligence to process your personal information. For example, we will use AI software within the Platform to process your provided content and profile information to summarise your property preferences and insights and assist you in determining your preferred property.
11. Third-party websites
Our website or Platform may include links to other websites or services operated by third parties. This privacy policy does not apply to the data processed by such third-party websites or services, and we have no control over the actions of those third parties in respect of your personal information.

When you use our website or Platform, we may use "cookies", traffic measurement software or other similar technologies to personalise or improve your user experience, including:
Functionality. These cookies allow us to make the website available to you, or to recognise you when you access the Platform and authenticate your login.
Analytics. These cookies help us understand how you use our website.
Non-essential. These include cookies which help us customise our website or Platform (or the contents of our website or Platform) for you, which help us improve our website and Platform.

13. De-identified information
We may create, use and store de-identified forms of information for our business purposes, including (without limitation) to conduct statistical analysis, carry out marketing activities, or develop and improve our products and services. As we take steps to remove or de-identify your personal information, this data cannot be associated with you.
14. Data retention We will store your personal information until you request for us to delete this information or within 30 days of deactivation of your Platform user account. We may also take steps to remove or de-identify your personal information if we no longer require your personal information to provide you with our products and services or another purpose for which your information was collected (as set out in this policy), or if required by law. However, we may retain:
(a) your personal information for another period to comply with any applicable law, for the prevention of fraud, to resolve disputes or for other legitimate purposes; and
(b) de-identified forms of your personal information for our business purposes, as further described at section 13 (De-identified information) of this policy.
15. Data security
We take reasonable steps to implement and maintain technical and organisational measures (such as, encryption for data in transit) to protect your personal information in our custody or control.
However data transfers made over the Internet are never 100% secure and if you send us any information, you acknowledge this is done at your own risk.

No fees apply to making a request for access or correction of your personal information.
We may refuse your request to access or correct your personal information for legitimate reasons, including if we believe that granting you access will endanger the life, health or safety of any person, would adversely impact the privacy of other individuals, that the request is frivolous or vexatious, or if your personal information is part of ongoing or pending legal proceedings between you and MyHomii.
